What is a Portfolio Review?

… and why does not doing it mean missed opportunities for land and property owners?

As Daylight, Sunlight and Rights of Light surveyors, we are often appointed by land or property owners wishing to imminently redevelop their sites to consider their options. Often, our clients don’t realise that by waiting until they want to redevelop they may be risking the development potential of their existing land and properties diminishing over time owing to the changing urban landscape and the evolving Daylight, Sunlight and Rights of Light position of their sites.

What can a portfolio review cover?

A review by Century Associates will always be tailored to the client and portfolio. Most, however, will include:

  • The age and uses of the client’s properties and surrounding properties

  • Whether any planning applications have been submitted in connection with surrounding properties that may impact Daylight and Sunlight to the client’s properties

  • Whether there are any planned or recently constructed developments that may have caused an infringement to Rights to Light enjoyed by the client and should be investigated further

  • A cursory review of title documents to determine whether any legal entries may significantly affect the rights position between the client’s properties and surrounding properties (subject to a legal review later)

  • Whether any Light Obstruction Notices (LONs) should be served on surrounding properties that are not yet of sufficient age to demonstrate Rights of Light but might restrict the development potential of the client’s properties once they do acquire rights

  • Whether any newer properties may demonstrate transferred Rights to Light that should be investigated
